Agreement to Terms
By accessing or using the Kaizumi website and services operated by Kaizumi LLC ("Kaizumi," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Description of Services
Kaizumi is a continuous improvement platform that provides AI-powered personalized training and educational resources, including:
- Personalized Training Modules — AI-generated Lean training with narrated micro-videos and knowledge checks, tailored to your industry, role, and company context (paid)
- Lean Dictionary — a free reference of 250+ Lean, Six Sigma, and continuous improvement terms
- Lean Tools — free interactive tools including Standardized Work Combination Tables, Standardized Work Charts, and Process Capacity Sheets
- Arcade — free educational games that teach operational excellence concepts
- Enterprise Training — custom curriculum design, learning management, and team deployment for organizations (by agreement)
Account Registration
Free services (Lean Dictionary, Lean Tools, and Arcade) do not require an account. To access paid features such as personalized training modules, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
Acceptable Use
You agree not to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Transmit malicious code or interfere with our services
- Attempt to gain unauthorized access to our systems
- Use our services to harm or exploit others
- Resell or redistribute our services without authorization
- Use automated systems to access our services without permission
Your Content & Uploaded Documents
You retain ownership of any content you upload or create using our services. By using our services, you grant us a limited license to store, process, and display your content solely to provide our services to you.
When you upload training documents (PDF or PPTX), we extract and generate an AI summary to build your personalized module. Both the original uploaded document and the AI-generated summary are retained for the duration of your subscription.
We do not use your uploaded documents, generated modules, or any other user content to train AI models. Our AI processing is powered by Google Vertex AI, which under Google's Cloud Data Processing terms does not use customer data to train its models.
You are responsible for ensuring you have the necessary rights to any content you upload and that it does not violate any third-party rights.
AI-Generated Training Content
Our platform uses AI to generate personalized training modules, including narrated videos, knowledge checks, and supporting materials. You acknowledge that:
- AI-generated training content is provided for educational and informational purposes
- Kaizumi is a Lean and continuous improvement training platform, not a domain-specific authority. Modules are personalized to your industry context, but the AI may generate references to industry-specific practices, regulations, clinical procedures, safety protocols, or technical standards that require independent verification by qualified professionals in your field.
- AI outputs may not always be accurate or appropriate for your specific situation
- You are responsible for decisions made based on AI-generated content and should not rely on it as a substitute for professional advice, compliance guidance, or domain-specific expertise
Shareable Module Links
Each generated training module includes a shareable link that allows others to view the module without creating an account. Shareable links remain active while the module owner's subscription is active (including during any grace period). Once a subscription expires, shareable links for subscription-type modules will stop working. One-time purchased modules retain their shareable links permanently.
Free Trial
We offer a 30-day free trial that includes 3 training module credits. A valid payment method is required to start the trial. If you cancel before the trial period ends, you will not be charged. If you do not cancel, your subscription will automatically convert to the selected paid plan at the end of the trial period.
Payment Terms
For paid services:
- Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method automatically at each renewal.
- Single module purchases are charged as a one-time payment. Access to one-time purchased modules does not expire.
- We may change pricing with 30 days' notice. Price changes do not affect your current billing period.
- Failed payments may result in your subscription moving to a past-due status. We will retry payment according to our payment processor's schedule before suspending access.
Cancellation & Refunds
You may cancel your subscription at any time with no penalties.
- Monthly plans: Access continues through the end of your current billing period. No refund is issued for the remaining days in the period.
- Annual plans: You receive a prorated refund based on unused module credits. For example, if you have used 10 of 36 credits on a Starter Annual plan, you are refunded the proportional value of the remaining 26 credits.
- Grace period: After your subscription ends, you have a 30-day grace period during which you retain full access to your modules and shareable links. After the grace period expires, access to subscription-type modules is revoked.
- Re-subscription: If you resubscribe at any time (including after the grace period), access to all previously generated modules is restored.
- One-time purchases: Modules purchased individually are never revoked, regardless of subscription status.
Free Services
We offer certain services for free, including the Lean Dictionary, interactive Lean Tools, and the Arcade. Free services do not require an account and are provided "as is." We reserve the right to modify, suspend, or discontinue free services at any time without notice.
Intellectual Property
Kaizumi and its licensors own all rights to our services, including software, designs, text, graphics, and other content. You may not copy, modify, distribute, or create derivative works without our written permission.
Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF OUR SERVICES IS AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAIZUMI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold Kaizumi LLC harmless from any claims, damages, or expenses arising from your use of our services, your content, or your violation of these terms.
Termination
We may suspend or terminate your access to our services at any time for violation of these terms or for any other reason. You may cancel your subscription at any time through your account settings or via the Stripe customer portal.
Upon cancellation, the terms described in the Cancellation & Refunds section above apply. Generated content is retained in our systems and can be restored if you resubscribe. We reserve the right to delete account data for accounts that have been expired for more than 12 months.
Changes to Terms
We may modify these terms at any time. We will notify you of material changes by email or through our services. Continued use after changes constitutes acceptance of the new terms.
Governing Law
These terms are governed by the laws of the State of Maine, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in the State of Maine.
